All orders are subject to product availability, supplier availability, and successful payment processing. If an item becomes backordered, discontinued, delayed, or unavailable, we may contact you with available options, including waiting for the item, selecting a replacement product, adjusting the order, or receiving a refund for the unavailable item.

2. Orders & Payment

All prices are listed in U.S. dollars unless otherwise stated.

Payment must be received at checkout before an order is processed.

We reserve the right to cancel, refuse, or limit any order for reasons including suspected fraud, pricing errors, product availability issues, supplier limitations, incorrect product information, shipping restrictions, or other business or operational concerns.

Prices, product descriptions, availability, inventory, and shipping options may change without notice.

3. Product Information

We work to provide accurate product descriptions, images, specifications, pricing, and availability. However, product information may be updated, changed, or corrected at any time.

Customers are responsible for reviewing product details, sizes, ratings, standards, manufacturer instructions, warnings, and intended use before purchasing.

Products should be used only in accordance with applicable manufacturer guidelines, workplace safety requirements, OSHA standards, ANSI standards, and any other applicable laws, rules, or regulations.

NYC Safety Supply does not guarantee that any product is suitable for a specific customer use unless expressly stated in writing by the manufacturer.

4. Shipping & Delivery

Orders may ship directly from partner warehouses, suppliers, distributors, or fulfillment locations.

Delivery times may vary based on product availability, supplier processing time, shipping carrier, destination, weather, holidays, and other factors outside our control.

Estimated shipping or delivery times are not guaranteed unless expressly stated.

Tracking information will be provided when available.

Some orders may ship in separate packages from different partner warehouses. Customers may receive multiple tracking numbers for a single order.

5. Returns & Refunds

Customers may request an eligible return within 30 days of delivery, subject to product eligibility and return approval.

Items must generally be unused, unworn, unopened when applicable, in original packaging, and in resellable condition.

For health, hygiene, and safety reasons, certain products may not be eligible for return once opened, worn, used, installed, activated, calibrated, contaminated, altered, or removed from their original packaging.

Items that may not be eligible for return include, but are not limited to, opened masks, respirators, filters, first aid products, medical products, used or contaminated PPE, fall protection equipment, hazardous or contaminated spill materials, activated or calibrated safety devices, custom items, special-order items, clearance items, final-sale items, cut-length items, and modified products.

If an item arrives defective, damaged, incorrect, missing, or incomplete, NYC Safety Supply will help review the issue and arrange the proper return, replacement, refund, or order correction when approved.

Approved refunds are issued to the original payment method after the returned item is received, inspected, and approved. Once approved, refunds are typically processed within 5–7 business days. Your bank or payment provider may require additional time to post the refund.

6. Product Availability & Backorders

Product availability may change at any time.

Inventory is confirmed at the time of purchase. In rare cases, an item may become unavailable after an order is placed. If that happens, we will contact you with available options, which may include a replacement product, backorder fulfillment, order adjustment, or a refund for the unavailable item.

NYC Safety Supply is not responsible for supplier inventory changes, manufacturer delays, carrier delays, discontinued products, or fulfillment delays outside our control, but we will work to assist customers when an issue occurs.

7. Limitation of Liability

To the fullest extent permitted by law, NYC Safety Supply is not liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, use, misuse, delay, delivery, installation, failure, or inability to use any product purchased through our website.

Customers are responsible for selecting products appropriate for their intended use, workplace conditions, safety requirements, compliance needs, training requirements, and applicable laws or regulations.

NYC Safety Supply does not provide professional safety, engineering, legal, medical, or compliance advice. Product information is provided for general purchasing purposes and should not replace manufacturer instructions, workplace safety programs, competent-person review, or professional guidance where required.

8. Third-Party Suppliers & Fulfillment Partners

Some products may be supplied, shipped, or fulfilled by third-party suppliers, distributors, manufacturers, or fulfillment partners.

Shipping times, product availability, packaging, return eligibility, replacement options, and fulfillment timelines may vary depending on the product and supplier.

NYC Safety Supply works with supplier partners to support accurate fulfillment, but certain supplier-controlled issues may be outside our direct control.

You agree not to use this website for unlawful purposes, fraudulent activity, unauthorized access, interference with website operations, scraping, data misuse, false orders, chargeback abuse, or any activity that may harm NYC Safety Supply, our customers, suppliers, partners, or service providers.
